Why NRIs Need a Power of Attorney for India

A Power of Attorney (PoA) allows an NRI to authorise a trusted person in India to act on their behalf for property purchase, sale, loan applications, court matters, banking, and other legal transactions. Without a PoA, NRIs must travel to India for every significant transaction — which is impractical and costly.

Types of Power of Attorney for NRIs

  • General Power of Attorney (GPA): Broad authority to act on all matters; useful for NRIs with multiple ongoing transactions
  • Special Power of Attorney (SPA): Limited to a specific transaction (e.g., sale of a specific property); more secure and recommended for property transactions

How to Execute a PoA from Abroad

  1. Draft the PoA: Have a lawyer in India draft the PoA with specific powers clearly defined
  2. Sign before a Notary: Sign the PoA before a Notary Public in your country of residence
  3. Apostille (for Hague Convention countries): Get the PoA apostilled by the competent authority in your country — UAE: Ministry of Foreign Affairs; UK: Foreign, Commonwealth & Development Office; USA: Secretary of State; Canada: Global Affairs Canada; Australia: Department of Foreign Affairs and Trade
  4. Attestation by Indian Embassy/Consulate (for non-Hague countries): Get the PoA attested at the nearest Indian Embassy or Consulate
  5. Send original to India: Courier the original apostilled/attested PoA to your representative in India
  6. Register in India: For property transactions, the PoA must be registered at the Sub-Registrar office in Kerala. The representative presents the original PoA with their ID proof.
